As a member of Assata’s New Jersey trial legal defense team, and her appeal lawyer, I think a correct statement of the circumstances of New Jersey Trooper Werner Foerster’s death as established by exhibits, trial testimony and forensic evidence and that conclusively repudiate the revisionist lies now being advanced by the State of New Jersey as “fact”, need to be repeated.

On Monday, Oct.6, in a ruling unrelated to death-row journalist Mumia Abu-Jamal's upcoming appeal of the recent Third Circuit decision denying a new guilt-phase trial, the US Supreme Court rejected his Post Conviction Relief Act (PCRA) appeal, which was asking the courts to hear newly discovered testimony from Kenneth Pate and Yvette Williams.
With this ruling, Abu-Jamal's upcoming appeal to the US Supreme Court of the Third Circuit decision (the filing of this appeal is due by Oct. 20 unless a 60 day extension is requested) is now more important than ever, because this is now his last chance for a new guilt-phase trial. This moment coincides with two new media projects that expose further injustice: the British film In Prison My Whole Life and the book The Framing of Mumia Abu-Jamal, by J. Patrick O'Connor.

The US Supreme Court has rejected Mumia's PCRA appeal based on the affidavits of Kenneth Pate and Yvette Williams. The appeal had been filed in July, after it was rejected by the PA Supreme Court in Feb, 2008, and in 2005 by Philadelphia judge Pamela Dembe.
This is completely separate from the appeal to the US Supreme Court re. the recent Third Circuit decision that denied a new guilt phase trial. The deadline for Mumia and the DA to appeal this to the US Supreme Court is October 20, unless Mumia's lawyer applies for a 60 day extension.

In the last four months over a dozen prisoners confined in the Special Management Unit (SMU) at State Correctional Institution (SCI) Camp Hill have written HRC/Fed Up! about conditions of severe brutality, white supremacy, and the systematic sabotage at all inmate efforts to file grievances and/or obtain legal assistance. One thing we need to keep is the Media in this story so please to everyone please post comments to CNN.com, CBS.com and make comments on the Troy Davis stories and email other national, state and local media where you live and tell them we want to know more about the Troy Anthony Davis case. One element I have noticed missing in all the , media outlets is that no one mentions that the Anti-terrorism and Effective Death Penalty Act is involved, and that is why Troy's case has got to this point. So we want to encourage the media to talk about law and how it does not protect the innocent by limiting the appeals process. If the media knows we want to know more they will do more stories on this case. So get you emails going to all national media. Continue to write op-eds, this is a case of innocence not just the death penalty, eyewitness identification, witness recantation and procedures of law.
