The defenders of the EFCA say it's available to employees, but do not explain how it is done.
The bill is fairly short and it doesn't address that directly. Is it implied some how?

Submitted by Thomas Adriaan Hellinger (no verificado) on Mié, 03/25/2009 - 8:02amThe option to have a secret ballot is not actually in the Employee Free Choice Act, but in the National Labor Relations Act. In the NLRA, it is stated that through a 30% card check a minority can force a decertification election one year after a valid election. Since the majority card check that EFCA would allow for unionization is not an "election", the decertification card check forcing a secret ballot election can be performed at any point immediately after a successful card check certification.
In this way the decision to have a secret ballot election is a decision that the workers make, not management. Obviously though there will be a lot of pressure from management to get workers to sign the cards for a decertification election.
Telling employees to be against EFCA
Submitted by Ryan (no verificado) on Vie, 03/20/2009 - 3:24pmRecently at a staff meeting, the meeting leader brought up the EFCA being introduced to Congress, and, after pointing out two or three times that "Obama supports it" added that she hoped "we were all against it." I spoke up, rather angrily, and said "Why?" Well, the ensuing discussion was written up, with me as the bad guy. I was wondering if there are any laws or regulations currently about whether supervisors, in a position of authority, can "advise" people how they should feel about this issue. My reaction was certainly over the top, but to tell us we should be against this particular issue seemed, well, really nasty. Any opinions on this?
I live in Colorado.
