Local REAL Nazi gets four years probation on assault, weapons charges

If we are going to have Jonah Goldberg articles about who REAL Nazis are - especially as wrongheaded as Jonah Goldberg articles usually are - then we had best make sure we have a good example of what a Nazi looks like. This one is a member of the Ironworkers' Union, and he just got four years probation for beating up a fellow Nazi and holding a gun to his head.
Two More Nazis Get Probation in Assault
One down, two to go. Andrew Boyle and Vinny DeFelice could not be sentenced today because their lawyer wasn't available, but Doug Caffarella's lawyer was - and considering how quickly he objected when Keystone State "Skinheads" was about to be mentioned, it doesn't bode well for Boyle and DeFelice. Caffarella got four years probation for that Memorial Day Weekend 2007 assault on a KSS hanger on, a case that saw convictions for Boyle and DeFelice, but not for Keith Carney, who was cleared of all charges last month. Now that four years probation for a guy who didn't have an adult criminal record. The same cannot be said for Boyle and DeFelice, so when we are in court on Friday, we might be able to understand why Vinny was upset about OPP being in the courtroom!

PHILADELPHIA, Jan. 7 - Douglass Caffarella, one of the three convicted Keystone State "Skinheads" associates that assaulted a hanger-on to the group almost two years ago, was sentenced to a total of four years probation today. The remaining two co-defendants will be sentenced on Friday due to a scheduling conflict with their lawyer.
Caffarella did not speak on his behalf as Judge Lillian Ransom sentenced him to two years probation on possession of an instrument of crime, namely the gun he was reportedly holding at the head of Eric Dottaviano, the man he assaulted, when police arrived, one year probation for the simple assault charge and one additional year for conspiracy. Caffarella's mother, sister and brother were also in the courtroom for support.
Prosecutor Randy Shaw had asked for 11½ to 23 months incarceration for Caffarella because of the weapon, as well as two years probation. Saying that the case "isn't your typical simple assault", Shaw began to suggest that Dottaviano, who never appeared in court, might not have done so because he was scared of doing so. As Shaw began to suggest that the Dottaviano was attempting to join the organization Caffarella and his fellow co-defendants Andrew Boyle Vincent DeFelice and Keith Carney reportedly belonged to, Caffarella lawyer immediately objected saying there is no evidence that this was the case, particularly with Dottaviano not appearing in court.
Caffarella's lawyer, painted him as someone who, with the exception of a juvenile arrest, never had any problems with the law in the past and that this incident is an aberration of his life. Caffarella, according to his lawyer, had recently obtained his GED, and is currently a member of the Ironworkers' Union, and has been serving an apprenticeship for the past two years.
After sentencing Caffarella, Judge Ransom took note of his record. "Up until this incident, you have had no contact with the criminal justice system," Ransom said to Caffarella. "Try to keep it that way."
Andrew Boyle and Vincent DeFelice will be sentenced on Friday, and could not be sentenced today because their attorney Mike Farrell was not in town. He had reportedly believed that sentencing was set for Friday as opposed to Wednesday, and the court was able to accommodate that schedule. The fourth defendant, Keith Carney had been cleared of all charges and was not in the courtroom during the sentencing of his comrades.

Update
Submitted by Anonymous (not verified) on Fri, 01/09/2009 - 3:31pmThe remaining two got probation as well. Looks like the court saw thru the bs and ridiculousness and let them all go with probation.
I don't know about that.
Submitted by Dave McKeown (not verified) on Sat, 01/10/2009 - 1:13amI don't know about that. From what I read about the case, the boneheads were up on attempted murder which then went down to aggravated assault, which then went down to simple assault. All of this after the cop saw them put the gun to the guy's head and they split the scene. Then there was that one other Nazi who was supposed to be their leader getting cleared on everything. So they did get a pass on a lot of shit that the average person would have been in jail for a long time ago.
What a waste!

Submitted by Anonymous (not verified) on Sun, 01/11/2009 - 4:50amThe whole thing about the gun being pointed at the guys head for one thing. When you read the articles in the papers about that night you'll see the cop said he was going to another call when he saw them punching and kicking the guy, so if they were beating him up and ran when the cop got there, then when did they have time to pull out a gun and point it at his head? The cop would have immediately drawn his gun and made get on the ground- running would only cause them to be shot for not putting it down because that's an endangerment to his life in the eyes of the law

Submitted by Anonymous (not verified) on Sun, 01/11/2009 - 3:17pmper the reports the cop was over a block away at night, no lighting and withing 10 seconds as he stated, in detail, which people did what each how many kicks/punches and that somehow he comes out, they all take off then get pulled over thinking its like a traffic stop a block away.
By the paper, its interesting, how does someone punch kick and have a gun to someones head at the same time?
How the case wasn't thrown out of court completely shows a bias against those kids. Politics or not, that whole case looked fraudulent.
Uh, there were three of them doing the punching and kicking!
Submitted by Anonymous (not verified) on Sat, 01/17/2009 - 12:39pmAndrew Boyle and Vincent DeFelice testified to their role in the punching and kicking, and Doug Caffarella was convicted on the weapons charge. He was the one pointing the gun to dude's head. The cop heard the commotion from where he was, went to investigate they saw him and jumped in the car. All of this they testified to, so what's the confusion?
