Police raid homes without probable cause all the time. Court throw out illegally gathered evidence every day. So the answer to your question is YES. Further, evidence gathered inside a house when the police only have probable cause and nothing more is still unconstitutional (violative of the 4th amendment's search and seizure clause). Police need either (1) voluntary consent, (2) a warrant, (3) probable cause AND exigent circumstances that the evidence is going to be destroyed.
